(Columbus, OH) An Ohio Supreme Court justice won't back away from an abortion case.
A Toledo-based clinic wanted Justice Sharon Kennedy to recuse herself from an appeal involving its future operations, after appearing before an anti-abortion group.
But the justice says she reviewed a request by Capital Care Network of Toledo to step aside from their case over whether the clinic should close and found the request "without merit." At issue was Kennedy's decision to speak to the Greater Toledo Right to Life in March.
The group claims the breakfast "legislative briefing" never mentioned abortion. An ethics complaint against Kennedy was dismissed-- that complaint based on the premise justices are required to disqualify themselves anytime their impartiality might be reasonably questioned.
