In a Twitter message earlier this week President Trump claimed that he alone holds the power to reopen the states. “It is the decision of the President, and for many good reasons." Trump went even further in stating “For the purpose of creating conflict and confusion, some in the Fake News Media are saying that it is the Governors decision to open up the states, not that of the President of the United States & the Federal Government. Let it be fully understood that this is incorrect,”
As expected many Governors disagree. And in fact The Constitution would seem to be on their side not that of the President. The Tenth Amendment is simple but clear in what it says "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."
The power to control states is not enumerated for the President, so it is in fact reserved for the state and its' people.
President Trump did not decide any of the restrictions states put upon themselves and therefore can't remove those restrictions.
But that's the legal argument. No one is even sure what President Trump means when he says he wants to "open the country" back up.
