Toledo To Appeal Lead-Safe Law Ruling

(Toledo, OH)   An appeal is in the works of a ruling that struck down Toledo's lead law.

City officials say the judge's ruling last week was not a surprise, but it opened a community conversation about lead hazards in older rental properties.  Last week's ruling found the law unconstitutional because it discriminated against small property owners and a judge found city leaders could not hand off enforcement powers to Lucas County public health officials.

Supporters believe they have the framework of a good law and want to amend the so-called lead safe law to meet the court's muster.

Opponents are trying to avoid what they call cumbersome and expensive regulations being placed on thousands of landlords.
